Journal Article 2025 07 13 Based on Shi‘a tradition, the morals of the Infallibles plays a role in various domains. One of the key areas where the morals proves effective is the domain of legislation, in which the morals of the Infallibles is employed to understand religious rulings and clarify jurisprudential teachings. In this regard, the household of the Prophet of God (S.A.W.) made use of this religious capacity and, by referring to the morals of the Infallibles, responded to the legal inquiries of their companions. However, a central question arises in this context: does the morals, like the traditions, function as an independent source of law, or is it only applicable in certain jurisprudential instances? To address this question, it is necessary to examine all jurisprudential instances of the morals and assess its effectiveness as a legislative source. The present article seeks to explain the role of the morals of the Infallibles in legislation, drawing on Shi‘a tradition and analyzing the approach of the household of the Prophet of God (S.A.W.). The findings of this study indicate that the morals, from the perspective of the household of the Prophet of God (S.A.W.), is regarded as one of the sources of legislation and plays a significant role in clarifying jurisprudential teachings. <span lang="FA" style="font-size: 11.0pt; mso-ansi-font-size: 10.0pt; line-height: 85%; font-family: 'B Nazanin';">بر پایۀ احادیث شیعه، سیرۀ معصوم در عرصه‌­های گوناگونی ازجمله در عرصۀ تشریع کارایی دارد. در این عرصه، سیره برای شناخت احکام شرعی مورد استفاده قرار گرفته و موجب تبیین تعالیم فقهی می‌شود. در این راستا، اهل‌بیت(ع) از این ظرفیت دینی بهره برده و با استناد به سیرۀ معصوم، به سؤالات شرعی اصحاب پاسخ داده‌­اند. امّا مسئله­‌ای که در این میان مطرح می­‌شود، این است که آیا سیره همچون سنّت در تراز یک منبع مستقل نقش ایفا می‌کند یا اینکه تنها در برخی مصادیق فقهی کارایی دارد؟ برای پاسخ به این مسئله باید همۀ مصادیق فقهی سیرۀ معصوم بررسی شده و میزان کارایی آن به‌عنوان یک منبع تشریع ارزیابی شود. مقالۀ پیش ‌رو کوشیده است با تکیه بر احادیث شیعه و تحلیل شیوۀ مواجهۀ اهل‌بیت(ع)، به تبیین جایگاه سیرۀ معصوم در تشریع بپردازد. نتیجۀ پژوهش نشان می‌دهد که سیره در نگاه اهل‌بیت(ع)، به‌عنوان یکی از مصادر تشریع شناخته شده و نقش مؤثری در تبیین آموزه‌های فقهی دارد.</span> https://mishkat.islamic-rf.ir/article_229511_610485bbe762450338d35d110ae8c530.pdf
